LEASE TERMS CLARIFIED + DETAILED.
UTILITIES, LANSDSAPE + INSURANCE.
UTILITIES.
1. Individually metered utilities must be contracted directly by tenant.
2. Tenant must keep utilities on during lease from first day to last day.
3. Shared meter utility accounts maintained + paid by owner or community.
4. Tenant reimburses share of utilities as determined by owner.
5. Copy of bills paid by owner will always be made available to tenant.
LANDSCAPE.
1. Tenant must maintain landscape in the same condition as received.
2. Care includes watering, pruning and weeding to maintain size + form.
3. Tenant may perform maintenance work themselves or hire service.
4. The owner may introduce the tenant to a service provider option.
5. Water features are considered a part of landscape to be maintained.
6. Tenant must maintain and repair water feature equipment.
7. Only actively used and maintained outdoor furniture may be left outdoors.
8. Stored items damages plants/structures, prevents care & attracts pests.
9. Items may be removed by owner or service provider without notice.
RENTERS INSURANCE.
1. Tenant required to obtain and maintain renter’s insurance during tenancy.
2. Minimum $100,000 in personal liability coverage.
3. Minimum $30,000 in personal property coverage.
4. Minimum $1,000 in medical bills coverage.
5. Owner must be included on policy as interested party with contact info.
6. Tenant must provide proof of insurance prior to move in and on request.
DURRING LEASE.
SECURITY + RENT PAYMENT METHOD.
1. Tenant must pay rent + any money due by method requested by owner.
2. Owner may change method at anytime due to changing bank options.
3. Owner will always provide an option that is free to tenant.
4. Tenant reimburses cost if they pay w/method causing owner bank fees.
5. Zelle, ACH, in bank check deposit or any direct deposit method accepted.
6. Typically monthly rent must be paid in a single transfer.
MAINTENANCE, REPAIRS + HELP.
1. Tenant to contact owner in the manner requested by the owner.
2. Typically be email or online form with description of issue + photos.
3. Tenant must have diagnostic of appliances before owner will repair.
NEIGHBORS + SHARED ACCESS.
1. Houses + apartments may have shared utility + access.
2. Tenant must provide access to items shared or that affect neighbor.
3. Landlord may share tenant contact information with neighbors.
4. Landlord may share exterior site gate keys or codes w/neighbors or service providers.
CHECK IN/OUT.
START AND FINISH OF LEASE 12 NOON.
1. Receive keys and move in no earlier than noon on the first day of lease.
2. Complete move out and return keys no later than noon last day of lease.
3. This is to make sure move in/out inspections are done with daylight.
4. This is also to provide time between tenant similar to a hotel check in/out.
MOVE IN FORMS.
1. When receiving keys tenant must immediately inspect property.
2. Tenant to immediately complete condition forms provided by owner.
3. If condition forms + photos are not done, condition is considered perfect.
KEYS + REMOTES.
1. Tenants may be provided only 1 set of keys or 1 gate/door remote.
2. Tenants may copy keys or purchase additional remotes.
ENDING LEASE.
45 DAYS NOTICE TO END LEASE.
1. Before the lease term ends, and when the lease is month to month, the tenant must provide 45 days notice to owner to terminate the lease, not just 30 days.
EARLY LEASE TERMINATION BUY OUT OPTIONS.
1. Tenant is responsible to pay all the rent for the entire length of the lease.
2. Buying a house, new relationships or moving for work can cause issues.
3. Tenant/owner agree to following early lease termination buy out options.
4. Option 1 provides the least penalty to tenant and disruption to owner.
OPTION 1: If the tenant breaks the lease and moves out before the lease period is complete, but stays current on their rent payments until a replacement tenant is found AND provide a replacement tenant that the landlord approves, then the tenant will pay a lease buy out fee equivalent to 1 months rent.
OPTION 2: If the tenant breaks the lease and moves out before the lease period is complete, but stays current on their rent payments until a replacement tenant is found by the landlord, then the tenant will pay a lease buy out fee equivalent to 2 months rent.
OPTION 3: If the tenant breaks the lease and moves out before the lease period is complete, stops making rent payments and does not provide a replacement tenant that the landlord approves. Then the tenant will pay a lease buy out fee equivalent to 3 months rent or equivalent to the amount outstanding unpaid rent, whichever is smaller.
EXTRA SERVICES.
1. If the tenant doesn't perform the maintenance or repairs for which they are responsible, the owner may perform or coordinate the work in which case the tenant will be responsible to pay extra rent for these services.
2. 110% of contractor or material costs incurred by the owner will be charged to the tenants as additional rent.
3. For each hour the landlord spends coordinating contractors the tenant will be charged and additional $75 in rent.
HOLD OVER RENT.
1. If the unit is not returned in the same condition as it was at move-in, the tenant will be charged rent for the days necessary for the landlord to return the unit to the original condition.
ADDTITIONAL TERMS.
RENT ADJUSTMENT.
1. For leases longer than 1 year or those that convert to month the month. After 1 year the rent will will automatically adjust according to the Consumer Price Index (CPI) averaging the previous twelve (12) month period, or the maximum amount allowed by local law.
ACCEPTING COMMUNITY RULES IN CONDOS.
1. In accepting this lease, lessee acknowledges that he/she has received, read, understood and approved of the covenants, conditions and restrictions set forth in the Amended and Restated Declaration of Covenants, Conditions and Restrictions for Sierra Terrace Condominiums Owners Association, together with the Articles of Incorporation, Amended and Restated Bylaws and Rules and Regulations of the Association. Lessee agrees to comply with the terms of those documents. Lessee also agrees and understands that any failure by Lessee to comply with the terms of those documents shall constitute a default under the lease.
